Terms & Conditions

All goods will be invoiced at prices ruling at the date of despatch. Prices are subject to change without prior notice. All prices are net of any discount.

Value Added Tax (VAT)
Terms are net of VAT (unless otherwise stated), VAT will be levied on all items where appropriate and shown separately when invoiced. VAT exemption claims (where applicable) should be made with a supporting certificate at the time of order.

Carriage and Small Orders
Delivery to UK Mainland: £7:50. Small orders (up to £60 ex VAT and discounts and excepting single use products) £5.00. Large items e.g Furniture and Sterilization/Cleaning equipment and deliveries to non-UK addressed to be agreed at time of order. Delivery to be in accordance with instructions but no liability will be accepted for loss through delays however caused. .

Notifications of a cancelled order shall only be valid when given in writing and agreed by Cheltenham Medical Company Ltd. If written notification is received Cheltenham Medical Company Ltd reserves the right to charge for cancellation up to 25% of the amount of the order (ex VAT , net of discounts).

Where the seller agrees to install and /or affix the product for the buyer then the seller shall be under no liability whatsoever for any loss or damage, whether direct or consequential and however so arising caused to the buyer or any third party during or as a result of installation.

Payment is due strictly 30 days from date of invoice(unless otherwise agreed) if an account has been established. Payment should be made payable to Cheltenham Medical Company Ltd, 12 All Saints Terrace Cheltenham Glos GL52 6UB UK. We reserve the right to charge interest on all overdue accounts at a rate of 2% a month on outstanding balance.

Title of Goods
All risk in the goods shall pass to the buyer but the beneficial title of goods does not pass to the purchaser until payment in full for the goods has been received by Cheltenham Medical Company Ltd. Until the date of such payment the buyer will hold the goods in a fiduciary capacity for Cheltenham Medical Company Ltd that in the event of prior resale Cheltenham Medical Company Ltd shall be entitled in law and equity to the proceeds of such sale or on any claims for the sale. The buyer shall at the request of Cheltenham Medical Company Limited's store the goods in such a way that they are clearly shown to be the property of Cheltenham Medical Company Ltd.

All orders for goods are accepted subject to the availability of raw materials , components and labour.

Refunds for incorrectly ordered goods
Where goods are ordered incorrectly a refund may be issued at the discretion of Cheltenham Medical Company Ltd. We reserve the right to charge 25% of the order value (ex VAT, net of discounts). Please contact us to agree a return when we will discuss arrangements for returning the goods. Costs incurred for collection, packaging and carriage will be passed to the purchaser, unless prior agreement is made.

Claims for Damages and Shortages
If goods are received damaged they should be signed for as such. All claims should be made in writing within 3 working days of receipt of goods which allows us to make a subsequent claim on our carriers. Shortages (number of parcels) should be signed for as such and notification given to us within 3 working days. Claims after this period may not be accepted. Goods should not be returned without prior authorisation.

Liability for Shortages
The liability for shortage, failure or defect of the goods supplied shall be limited to the cost of making good any such shortage, failure or defect. We will not accept any consequential losses.

Non Account Holders
Goods can be supplied on cash, cheque , against a proforma invoice with any order or by credit or debit card.

If a dispute should arise, all matters concerning the contract are to be construed according to English Law. If goods are subject to any dispute or have been tendered for or delivered but not paid for Cheltenham Medical Company Ltd may require the dispute to be referred to arbitration. The arbitration of a person should be mutually agreed on, or failing such agreement at the request of Cheltenham Medical Company Ltd a person will be appointed by the Chartered Institute of Arbitrators and should be made within 14 days of both parties being aware of the dispute.

If the buyer becomes insolvent or compounds with its creditors or acts in such a way which affects their ability to pay for goods, Cheltenham Medical Company Ltd reserve the right to collect the goods which have already been delivered or stop those in transit.

Cheltenham Medical Company Ltd is committed to protecting the identity and privacy of our users. We do not stores financial information and we will only use information collected in the process of transactions in accordance with The Data Protection Act 1998. We will not use emails to contact clients once the transaction has been completed other than in accordance with a query from them. Email addresses will not be provided to any third party. Unless you decide otherwise the only emails you may receive from Cheltenham Medical Company Ltd are updates to any recent orders and/or returns. You may request details of personal information which we hold about you under the Data Protection Act 1998. A small fee will be payable

All quotations, products supplied and contracts entered into are free of all liability, which may be caused by circumstances beyond the control of Cheltenham Medical Company Ltd, including Acts of God, Fire, Government control, Accident, Strikes, Lock outs and other similar circumstances.
